Hire Agreement including Terms and Conditions of Hire

Delivery Policy

Notes : Inflatables will be delivered up until 11.00am on morning of hire and collected from 7.00pm. Additional charges will be applied if you wish to keep the inflatable after this time period. We do not deliver outside 30km of Callan during May.

Refund/Deposit/Billing Policy

Bookings are confirmed by a 10% Deposit non Refundable. Bookings accepted by us cannot be cancelled by the customer except upon terms which will indemnify us against any actual or anticipated loss and expenses. A minimum of 10 days cancellation notice must be given with no refund of deposit by Sonix Entertainment.Please be informed that we will be storing your card details on file during the entire rental period. We reserve the right to charge your card for any damages, unpaid fees, or failure to make payment on the rental day. If payment is not received within 72 hours of receiving the equipment, we may initiate an automatic payment from the stored card details. Please ensure that you have sufficient funds to cover the rental charges and any additional fees that may apply. Thank you for your understanding.

Delivery/Setup Setup

  • Please note that while we will safely anchor the inflatable, it is the hirer's responsibility to ensure that there are no underground cables, pipes, or other hazards that could be damaged by the anchor pegs. Additionally, most of our equipment requires a 13amp 240V power supply (or generator at an additional cost, plus fuel cost afterwards).
  • Please ensure that you have sufficient space for the inflatable to be delivered to the site. Failure to provide enough space for delivery will result in full payment. Similarly, you must have adequate space for the equipment to be set up. Failure to provide sufficient space will also result in full payment.
  • Thank you for your understanding, and please contact us if you have any questions or concerns regarding the delivery and setup of your equipment.

INSURANCE

Sonix Entertainment holds Public Liability Insurance for its equipment only. Sonix Entertainment will not accept any responsibility for any injury caused to anyone using this equipment, however caused. Adult Supervision is required at all times. By accepting our equipment you are accepting our terms and conditions. Additional personal liability cover can be arranged through your home insurance. Duty of Care does not lie with us, you can get injured, seriously harmed or even die by using our equipment.

INFLATABLES ON HIRE OR LOAN
Sonix Entertainment would like to reassure you that all our units are manufactured and fully comply with EU Standard EN14960-2019.

Please carefully read all our terms and conditions and our risk position statement. Promoting sensible risk management.
The I.I.H.F. acknowledge that all play has risks and if an inflatable is introduced to enhance the experience of the play then it naturally increases the risk to the users. Play and risk are fundamentally linked and risk at play cannot be avoided. Acceptable risk is recognised as beneficial to development.
Sonix Entertainment has taken all possible steps to make your inflatable as safe as possible. It is erected and made ready for you by our trained staff to comply with the operational side of the EN14960-2019. By signing this hire agreement, you understand and agree that while the inflatable increases the risk of injury, we have done all in our power to not eliminate, but to reduce this risk as much as possible.
The person signing this agreement declares when they are signing that they are the person who has the full responsibility to ensure that all the terms and conditions contained herein will be adhered to from the time the inflatable is delivered by Sonix Entertainment to the time it is picked up by Sonix Entertainment

TERMS & CONDITIONS OF HIRE:
1. All equipment on hire or loan shall remain the property of Sonix Entertainment or their suppliers.
2. All equipment is used entirely at the Hirees’ / Users own risk, whether or not the equipment is staffed or self-run. 3. Any excessive dirt, loss or damaged equipment will be charged at full replacement / repair cost.
4. Any damage or loss must be reported immediately.
5. On delivery and after full inflation/installation the equipment should be inspected by the Hiree and any visible faults reported as soon as possible. Any visible fault not reported at the time of delivery and after full inflation/installation will be deemed to be the responsibility of the Hiree subject to such visible fault not being due to the negligence, an act or omission of Sonix Entertainment
6. Hirees’ must ensure that:
a. Access is available at the stated time of delivery.
b. The proposed operating site for the equipment is clear of any obstacles that may prove to be a hazard for the safe operation of the equipment.
c. The position of any underground services, water pipes, gas pipes, electrical cables, sewer pipes, domestic oil pipes, etc, are clearly indicated to the delivery staff prior to installation of equipment.
d. The Hirees’ representative has the authority to sign for delivered equipment and receive any safety/operating instructions.
7. Once equipment is installed it must not be moved, have items added to, be altered in any way or used for any other purpose other than that which it has been designed for, without the written permission from Sonix Entertainment All equipment must be used in accordance with all relevant legislation, all operating instructions issued by Sonix Entertainment and in a suitable safe environment.
8. The Hiree is responsible for ensuring that adequate first aid facilities are available if necessary.
9. The Hiree is responsible for ensuring that all safety regulations are enforced, and that equipment is constantly supervised as per the operating instructions issued. 10. The Hiree is responsible for ensuring that the equipment is not used in inclement weather conditions.
11. In the unlikely event of an accident occurring, full written details including, name and address of injured party, names and addresses of witnesses, circumstances of accident must be recorded, and a copy sent to Sonix Entertainment IMMEDIATELY.


OPERATING INSTRUCTIONS FOR SAFE OPERATION OF INFLATABLE:
The person or company hiring the inflatable is totally responsible for the safe operation of the inflatable and should ensure the following:

A. In the event of winds over 18 - 24 mph (29-38km/h) it is the responsibility of the hiree to switch off the inflatable and deflate in a safe manner. Inflatables are extremely dangerous if used above the recommended maximum wind speed including gusts. Always be on the side of caution at all times.
B. The inflatable has constant supervision by an adult who is of clear mind and not under the influence of alcohol or other mind-altering drugs. C. To admit users to the inflatable in a controlled and safe manner.
D. To restrict the maximum number of users at any one time to the design number for the particular inflatable or if design number is not immediately available or known restrict numbers so as not to dangerously overcrowd the unit using common sense and by erring on the side of caution in this matter. (As per safety label on the inflatable unit)
E. To restrict the maximum height of users at any one time to the design height for the particular inflatable or if design height is not immediately available or known restrict the height to the smallest wall height of the inflatable.
F To use at least the minimum number of operating personnel or supervisory attendants
G That users remove sharp or dangerous objects from their person and glasses where practical.
H To prohibit food, drink, or gum on the unit
I To prohibit users from hanging or climbing on containing walls
J To prohibit somersaults or rough play
K That operators and or attendants watch the activity on the inflatable constantly
L That operators and or attendants separate larger, more boisterous users from smaller ones
M Do not allow anyone to bounce, play or sit on the front safety step as a Child could easily bounce off the inflatable and get hurt. The step is there to assist users in getting on or off.
N. No smoking or barbecues near the inflatable.
O DO NOT ALLOW CHILDREN TO OPERATE THE UNIT!



WAIVER OF LIABILITY AND ASSUMPTION OF RISK

I the 'Customer voluntarily make and grant this Waiver of Liability and Assumption of Risk in favour of Sonix Entertainment as partial consideration (in addition to monies paid to Sonix Entertainment) for the opportunity to use the facilities, equipment, materials and/or other assets of Sonix Entertainment; and/or to receive assistance, training, guidance and/or instruction from the personnel of Sonix Entertainment; and/or to engage in the activities, events, sports, festivities and/or gatherings sponsored by the Sonix Entertainment; I hereby waive and release any and all claims whether in contract or for personal injury, property damage, damages, losses and/or death that may arise from my aforementioned use or receipt, as I understand and recognise that there are certain risks, dangers and perils connected with such use and/or receipt, which I hereby acknowledge to have been fully explained to me and which I fully understand, and which I nevertheless accept, assume and undertake after inquiry and investigation as to the nature and extent of such risks has shown those risks to be wholly satisfactory and acceptable to me. I further agree to use my best judgement in undertaking these activities, use and/or receipt and to strictly adhere to all safety instructions and recommendations, whether oral or written. I hereby certify that I am a competent adult assuming these risks of my own free will, being under no compulsion or duress. I hereby take full responsibility of the assets in good order and am fully responsible for the supervision and safekeeping and informing other persons and/or guardians of the risks associated with the using of the equipment’s and the responsibility of Liability and Assumption of Risk is wavered from Sonix Entertainment.

All monies are due on date of Event on Delivery.

Any individual / group which significantly reduces its numbers or changes its event / programme date(s), will be treated in the same way as the cancellations outlined above. Event organisers should contact the Operations Manager prior to booking if they have any special programme needs. Event organisers must ensure that the site they have allocated for their chosen activity(s) is suitable area is large enough for chosen activity(s) to operate safely, vehicle access routes are clear of obstructions and spacious enough, and the ground conditions of allocated site are grass or tarmac - ‘hard flat ground’.Event organisers must ensure that vehicle access routes are clear immediately before and after hire period has started and ended, so activities and associated vehicles can enter/leave site and venue without delay. If there are delays additional hire fees will be charged. If equipment is to be brought up stairs then a surcharge will be added of €100. If equipment is to be lifted into an area which specialist equipment is required the client will be responsible for Charges.i.e

General Booking conditions
The booking conditions set out below do not conflict with our policy of supplying a first class service. They are chiefly intended to be protection against unreasonable claims. No report, representation or statement made by any of our representatives shall be binding, this document alone evidencing terms of our offer. The contract of sale is to be construed in accordance with the law of the Republic of Ireland and shall not be assignable without our written consent. Festive nights such as New Years Eve, St. Stephen's night and bank holidays may incur extra charges. Payment must be made in full on the night of the event. Prices quoted are subject to revision if increase in the cost of materials, labour, travel, revaluation of currencies, duties or other circumstances arising before completion of the order, render such action necessary. Sonix Entertainment accepts no responsibility whatsoever for any equipment used during the event, which has not been supplied by Sonix Entertainment and only in instances where Sonix Entertainment are proven to be in some way culpable and/or negligent. Loss or damage: Save as herein expressly provided we shall not be liable for any consequential or other loss, damage, injury or expenses whatsoever arising out of the use of equipment or any property not supplied by us or arising out of faults (if any) therein and the client shall indemnify us against such and every claim by any third party. The customer warrants that the appropriate power supply is available. If no choice of music is selected by the customer, Sonix Entertainment will have sole discretion in what music is played.
FORCE MAJEURE: Every effort will be made to carry out the contract, but it's due performance is subject to cancellation by us or to such variation as we may find necessary as a result of inability to secure labour, materials or supplies as a result of an act of God, war, strike, lockout or other labour dispute, fire, flood, weather conditions, legislation or other such cause (whether of the foregoing class or not).
